Terms of Use for PocketKana

1. Acceptance of Terms

By downloading, accessing, or using the PocketKana mobile application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and the developer of PocketKana ("I", "me", or "my").

2. License Grant

I grant you a personal, limited, non-exclusive, non-transferable, and revocable license to install and use the App for personal, non-commercial educational purposes on an iOS product that you own or control, strictly in accordance with these Terms and the Apple App Store Terms of Service.

3. App Content and Educational Disclaimer

PocketKana is designed as a supplementary tool for learning the Japanese Hiragana and Katakana writing systems.

• No Guarantee of Accuracy: While I strive to provide accurate translations, romaji readings, and audio pronunciations, language is nuanced. I do not guarantee that the educational content is entirely error-free, complete, or perfectly suited to every dialect or regional context.
• User Responsibility: You agree that your reliance on the App’s content is solely at your own risk. The App is not a certified academic curriculum.

4. In-App Purchases

PocketKana is currently provided free of charge. In the future, the App may offer a one-time in-app purchase to unlock premium features.

• Payment Processing: All purchases are handled securely and entirely through Apple via your App Store account. I do not process payments or retain your financial information.
• Refunds: Because Apple manages all transactions, any request for a refund must be submitted directly to Apple Customer Support in accordance with Apple’s refund policies.

5. Intellectual Property Rights

All rights, title, and interest in and to the App—including its original code, design, UI/UX, graphics, custom audio files, and structural layout—are owned by me and are protected by copyright and intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from the App without my explicit written permission.

6. Privacy

Your privacy is fundamentally respected. PocketKana does not collect, store, or transmit your personal data, and all study progress remains stored locally on your device. For full details, please review the separate Privacy Policy.

7. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, I EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. I DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, BUG-FREE, COMPLETELY SECURE, OR FREE FROM ERRORS.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL I BE PERSONALLY LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APP. THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES FOR LOSS OF DATA (INCLUDING LOCAL STUDY PROGRESS), DEVICE MALFUNCTIONS, OR RELIANCE ON THE APP'S EDUCATIONAL CONTENT.

9. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, you acknowledge and agree that:

• These Terms are concluded between you and me only, not with Apple.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

11. Changes to These Terms

I reserve the right to modify or replace these Terms at any time. If a revision is material, I will provide updated terms within the App or on the App's website. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised Terms.
